A MAGISTRATE has described a 51-year-old man's behaviour towards his niece as predatory and disgusting.

The truck driver pleaded guilty to one count of sexual assault in the Rockhampton Magistrates Court yesterday.

Police prosecutor Clancy Fox told the court the man and the victim were at a family function late last year when the incident took place.

He said the woman was out on the patio by herself when the defendant approached her, commented on her breasts and told her he wanted to have sex with her.

Mr Fox said the defendant then put his hand down the victim's pyjama top, grabbed her breast and squeezed it.

He said he asked if she had a boyfriend and told her 'she knew where to find him if she got lonely', before he left. The court heard the victim was about 20 years old.

Defence lawyer Joanne Madden said the victim had been showing photos of herself to him prior to this, some were of herself topless.

"It seems to be an isolated incident," she said.

Ms Madden said the defendant was remorseful and understood this behaviour was unacceptable. She said since this, he had been alienated from his family.

Magistrate Jeff Clarke described the man's behaviour as predatory and disgusting before sentencing him to a six-month prison term, wholly suspended and operational for two years.
