Noosa car dealer fined $600 and cops ban for money misuse

A NOOSA motor dealer has been fined in court, as the Office of Fair Trading claims another Sunshine Coast scalp.

Brian Lennox Millard, of Millard's Noosa Motors Pty Ltd, pleaded guilty in Noosa Magistrates Court on Wednesday.

He faced 15 charges under the former Property Agents and Motor Dealers Act 2000, for which he was fined $6000 and banned from holding a motor dealer's licence for two years.

Millard had a conviction recorded against his name for the offences, which related to the misuse of client's money and the selling of encumbered vehicles.

The court heard Millard had sold six vehicles on behalf of their owners for a commission, with four of the six vehicles sold having money owed on them from previous owners, which Millard failed to tell the purchasers.

The court was told Millard then deposited the proceeds from the sales into his personal bank account, rather than his trust account, and didn't pass the money from the sales to the rightful owners, leaving consumers out of pocket to the tune of $180,032.47.

Millard used the money to keep his business afloat.

Despite having more than 20 years' experience in the motor dealer industry, the court heard Millard had been prosecuted for similar offences previously.

Fair Trading executive director Brian Bauer said the disqualification was a positive move and sent a strong message to others.

"A motor dealer can't legally sell a vehicle that has money owning on it, unless they are acting for the secured creditor," he said.

The claim fund paid out almost $200,000 to Millard's victims, and Millard was required to repay the sum.
