Man loses battle over property valuation

A MACKAY man has lost a legal battle with the state's valuer-general over the valuation of his Andergrove property.

David Phillipes was told that his Banksia Avenue property had been valued at $210,000 as of October 1, 2012, but he claimed it was more likely in the vicinity of $180,000 given Mackay's slumping property market.

Mr Phillipes took his fight to the Queensland Land and Environment Court in a bid to get the valuer-general's ruling overturned.

Mr Phillipes claimed, at a hearing in August last year, the property market was in decline due to the downturn in mining activity.

But evidence he produced at the hearing showed the Mackay property market had remained strong in 2012 and only started to decline the following year.

Member Paul Smith, in handing down his findings last week, said Mr Phillipes, who represented himself, did an admirable job in presenting his case.

"He is clearly an astute investor . . . perhaps more astute than purchasers of property in Mackay in 2012," he said.

"The appellant (Mr Phillipes) has failed to establish on the balance of probabilities that the valuer-general's valuation is incorrect and accordingly the appeal must be dismissed."

The valuer-general is responsible for determining land prices and is used to determine rating and land tax purposes.
