Victim’s brother had affair with wife of accused: court

A ROCKHAMPTON murder victim's brother had sex "many times" with the wife of the man accused of the killing, a jury has heard.

The Supreme Court trial of Mohammed Khan was told on Wednesday the sex happened at "many different places".

Mr Khan has pleaded not guilty to the murder of Syeid Alam on or about April 5, 2016.

Mr Alam was decapitated and his remains were found in a gully off the Fitzroy River.

Syeid's brother Sha Alam Sha Alam told the court, through an interpreter, that he had sex with Mr Khan's wife Suparti Suparti at her home and also at Syeid's house.

The trial heard that Sha Alam Sha Alam was living in Sydney in 2015 when Syeid was residing in Rockhampton.

Sha Alam Sha Alam said he came to Rocky to visit Syeid about "four to five times in total".

He said he met Suparti Suparti at TAFE in Rockhampton in 2013 where they both studied.

Sha Alam Sha Alam said when he met Suparti Suparti, he did not know if she had a husband. He said he later found out she was married.

Crown prosecutor Joshua Phillips asked Sha Alam Sha Alam what year it was that he found out that Suparti Suparti was married to Khan.

Sha Alam Sha Alam said it was 2015 or 2016.

But he couldn't remember the year he first had sex with Suparti Suparti.

Mr Phillips asked Sha Alam Sha Alam how many times he'd had sex with Suparti Suparti.

The response was: "I can't remember exactly but many times."

Sha Alam Sha Alam told the court when he was not in Rockhampton he communicated with Suparti Suparti through Facebook, on the phone and Skype.

He said during Skype calls Suparti Suparti showed her breasts and vagina.

Mr Phillips asked Sha Alam Sha Alam if he kept an image of that, to which he responded: "Yes I did."

Sha Alam Sha Alam further said: "Those were in the phone."

When asked if he shared that image with anybody, Sha Alam Sha Alam said: "Yeah actually I didn't show anyone but my brother's Apple ID and my ID was the same.

"When I do anything and that it goes to his phone.

"When he do anything, download or anything, it come to my phone as well because that phone was provided to me by my brother."

Mr Phillips asked Sha Alam Sha Alam if he discussed what he was doing with Suparti Suparti, with his brother.

The reply was: "Yes when my brother got to know that and then he actually told me not to do that, and then after that actually I left from there."

Sha Alam Sha Alam said that was a face-to-face discussion that happened in Rockhampton either at the end of 2015 or the beginning of 2016.

Defence barrister Andrew Hoare put it to Sha Alam Sha Alam that Syeid had told him to stop seeing Suparti Suparti in either January or February of 2016.

"Yes he did," Sha Alam Sha Alam said.

Mr Hoare: "And what he said to you was, that he was good friends with Mohammed Khan and what you were doing might affect his relationship with Mohammed Khan."

Sha Alam Sha Alam: "Yes."

Mr Hoare said at that point Syeid told Sha Alam Sha Alam that he was going to tell Mohammed Khan about the affair.

Sha Alam Sha Alam replied: "No actually he didn't told me that he was going to tell Mohammed Khan."

The trial continues.
