Adani to join court hearing against Federal Government

ADANI Mining has joined the court fray in the Australian Conservation Foundation's legal challenge against the mining giant's Carmichael mine and rail project.

The environmental group has taken the Federal Government to court on the basis Environment Minister Greg Hunt did not correctly apply the law under the UN World Heritage Convention when considering the impacts the project would have on the Great Barrier Reef.

Adani, the company behind the $16 billion Carmichael project in the Galilee Basin mine, will act as the second respondent in the Federal Court hearing.

On November 17, a judge ruled Mr Hunt must serve and file an affidavit setting out the decision-making process he followed and the material he considered when he approved the project.

The hearing will be set down for two days in April 2016.

ACF will argue the impact of climate pollution from burning the mine's coal would be inconsistent with Australia's international obligations to protect the reef.

The court will also consider the mine's impact on the endangered black-throated finch.

The Federal Court set aside the project's approval in August after the Mackay Conservation Group successfully argued the mine had not properly negated its impact on two vulnerable species - the yakka skink and the ornamental snake.

In October, Mr Hunt re-approved the mine 160km north-west of Clermont with what the government described as 36 of the strictest conditions in Australian history.
