Breast cancer charity tin thief jailed for six months

A 23-YEAR-OLD man who stole a McGrath Foundation Breast Cancer donation tin from the counter of an Oakey store has been sentenced to six months jail.

A drunken Edward Robert Wayne Burns had gone to the Oakey BP Service Station about 5am, October 25, to buy a packet of cigarettes, Toowoomba Magistrates Court heard.

When the attendant turned her back to get the cigarettes, Burns slipped the donation tin, which had about $300 cash, under his shirt.

After he left, the attendant noticed the tin missing and checked the store's CCTV footage which showed Burns taking it, police prosecutor Sergeant Mike Robinson told the court.

Police who viewed the tape identified Burns who was known to them from previous offending.

Burns left the area but was spotted by police in Cunnamulla entering a house on Thursday.

Initially giving police a false name, Burns struggled with police when arrested, Sgt Robinson said.

When another man entered the struggle, Burns was able to flee but was found hiding under a house in a nearby street and arrested.

He pleaded guilty to stealing the cash tin and obstructing police.

Burns, who was on a return to prison warrant, had a full-time release date from his previous sentence of December 15, the court heard.

Magistrate Graham Lee described the stealing of the cash tin as a "despicable act" and sentenced Burns to six months in jail but ordered he be eligible to apply for release on parole as of January 13 and ordered he pay $300 restitution.
